Art. 13. Únicamente el Poder Ejecutivo en paz o en guerra podrá conferir ascensos en la forma que establece el Código Militar. Los Comandantes en Jefe y Jefe de operaciones en campaña proveerán las vacantes que ocurran en sus Cuerpos de ejército por medio de nombramientos hechos con el carácter de transitorios o en comisión, pero sin otorgar ascensos.
