No obstante lo dispuesto en el artículo anterior, queda autorizado el Poder Ejecutivo para resolver que la construcción de la Aduana se haga sobre la orilla del cauce principal del rio Magdalena,

en cuyo caso prescindirá de dar garantía de interes sobre el ferrocarril proyectado entre dicho rio i la ciudad de Barranquilla.
