Cumplida la captura, el sindicado queda detenido preventivamente y debe ser indagatoriado dentro de las doce horas siguientes. Antes de iniciar la indagatoria se pedirá al sindicado que nombre a un oficial como su defensor; si no lo hace el funcionario de instrucción le nombrará uno de oficio. Posesionado el defensor, se iniciará la diligencia de indagatoria.
