El funcionario, si hallare fundada la denuncia, la mandará notificar al denunciado, para que en el término de la distancia y cinco días más, se presente a estar a derecho en el juicio, debiendo suspenderse mientras tanto el curso de éste.

Si no se hallare fundada la denuncia, también se mandará notificar, pero no se suspenderá el curso del juicio.
