Las sanciones disciplinarias se aplicarán teniendo en cuenta la naturaleza de la falta, las funciones desempeñadas por el infractor, su grado de participación en aquella, y sus antecedentes en calificación y sanciones. Para dicha apreciación, el Ministerio Público allegará al proceso los antecedentes del acusado. Las pruebas se apreciarán según las reglas de la sana crítica.
