La persona interesada en ello, con la prueba que lo acredite, puede presentarse al Juez competente demandando a cualquier asignatario para que manifieste si acepta o repudia la asignación que se le ha deferido, y el Juez debe ordenar inmediatamente que se le haga al demandado la notificación de que trata el artículo 1289 del Código Civil, y practicar las demás diligencias que ordena dicho artículo.
