No podrá empeñarse cosa ajena sin autorización del dueño. Si constituida la prenda el acreedor tiene conocimiento de que los bienes pignorados son ajenos, tendrá derecho a exigir al deudor otra garantía suficiente o el inmediato pago de la deuda.
