Las garantías marítimas de las naves y artefactos navales de más de 500 toneladas a los cuales se refiere la presente ley, se regirán por la Decisión 487 del Acuerdo de Cartagena sobre Garantías Marítimas (Hipoteca Naval y Privilegios Marítimos) y Embargo Preventivo de Buques o por las normas que la modifiquen o reemplacen. Las garantías marítimas de las demás naves y artefactos navales se regirán por el Código de Comercio. En caso de no existir norma aplicable, las garantías marítimas se regirán por los convenios y tratados internacionales que rijan la materia.
