El inferior que por cumplir una orden del servicio cometiere un delito, sólo será responsable en caso de concierto anterior simultáneo o subsiguiente a la ejecución del mismo delito por exceso en dicha ejecución, o cuando hubiere obrado con manifiesta malicia. y, en estos casos se tendrá siempre en cuenta el ordinal 5° del Artículo 122 anterior.
