Los elementos a que se refieren el inciso 1° del artículo 9° del Decreto-ley 1208 de 1973 y el artículo 59 del Código Penal, pasarán al Fondo Rotatorio del Ministerio de Justicia, una vez que se haya ordenado su confiscación, o cuando, habiéndose dispuesto su devolución, no hubieren sido reclamados por el interesado dentro de los tres meses siguientes a la ejecutoria de la providencia que ordeno su entrega.
