El servidor público que indebidamente dé a conocer documento o noticia que deba mantener en secreto o reserva, incurrirá en multa y pérdida del empleo o cargo público.

Si de la conducta resultare perjuicio, la pena será de de dieciséis (16) a cincuenta y cuatro (54) meses de prisión, multa de quince (20) a sesenta (90) salarios mínimos legales mensuales vigentes, e inhabilitación para el ejercicio de derechos y funciones públicas por ochenta (80) meses.

Nota: La modificación realizada por el artículo 25 de la Ley 1288 de 2009 , fue declarada INEXEQUIBLE por la Corte Constitucional mediante Sentencia C - 913 de 2010,
