Si la prenda no pertenece al que la constituye, sino a un tercero que no ha consentido en el empeño, subsiste sin embargo el contrato, mientras no la reclama su dueño; a ménos que el acreedor sepa haber sido hurtada, o tomada por fuerza o perdida, en cuyo caso se aplicará a la prenda lo prevenido en el artículo 2208.
