El que se fugue, estando legalmente detenido por imputársete la comisión de un delito, incurrirá en arresto de cuatro meses a dos años. Si se tratare de un condenado, la sanción será de tino a cinco años de prisión. La pena se aumentará de una tercera parte a la mitad si la-fuga se verificare empleando violencias contra las personas o las cosas.
