Obtenido el certificado de disponibilidad expedido por el Contralor General, el Ministro de Hacienda someterá el expediente del crédito a la aprobación del Consejo de Ministros, y una vez aprobado por dicha entidad, lo enviará al Consejo de Estado para su dictamen. Si el Consejo de Estado emitiere concepto favorable, el Gobierno dictará el decreto de apertura del crédito. En caso de concepto desfavorable, se archivará el expediente.
