No habrá lugar a responsabilidad penal en las conductas descritas en los artículos anteriores, cuando el agente o la madre recoja voluntariamente al abandonado antes de que fuere auxiliado por otra persona, siempre que éste no hubiere sufrido lesión alguna.
Si hubiere sufrido lesión no habrá lugar a la agravante contemplada en el inciso 1 del artículo siguiente.
