Las cauciones que deben prestarse según este código, o a virtud de otras leyes, no se admiten por el Juez sin que se presente la prueba, siquiera sumaria, sobre la suficiencia de ellas.

Admitida la caución puede prestarse en el acto, lo que no impide su caducidad si el fallo que la admite es revocado.
