Al delegar una función se establecerá claramente que la entidad delegataria adquiere los respectivos poderes y facultades legales del instituto, y queda sometida a los mismos requisitos y formalidades prescritos para este por la ley 75 de 1968. Igualmente se establecerá que los actos de la entidad delegataria deberán ser adoptados por esta de conformidad con las disposiciones legales o los estatutos que rijan su funcionamiento, que no requerirán intervención alguna del Instituto; y que, cuando la ley exige el voto favorable del Ministro de Salud Publica, o aprobación del Gobierno, el acto correspondiente de la entidad delegataria deberá ser aprobado por el ministro o por el gobierno, según sea el caso.
