Es aquella facultada por la ley para otorgar el derecho a explorar y explotar el suelo y el subsuelo mineros de propiedad nacional. - Explotadores mineros de hecho . Son las personas que sin título minero vigente, lleven a cabo explotaciones de depósitos y yacimientos mineros.
