Si noventa (90) días después de acreditado legalmente el derecho a disfrutar de pensión de jubilación, invalidez o retiro por vejez, tal derecho no ha sido reconocido ni pagado, la empresa o patrón obligados a efectuar dichos reconocimientos y pagos, deberá cubrir al interesado, además de las mensualidades pensionales hasta el día en que el pago de la pensión se verifique, suma igual al salario que el beneficiario de la prestación venía devengando.
