En la venta de un "cuerpo cierto", el riesgo de la pérdida por fuerza mayor o caso fortuito ocurrido antes de su entrega, corresponderá al vendedor, salvo que el comprador se constituya en mora de recibirlo y que la fuerza mayor o el caso fortuito no lo hubiera destruido sin la mora del comprador. En este último caso, deberá el comprador el precio íntegro de la cosa.
