Art. 1371. El albacea fiduciario deberá jurar ante el Juez que el encargo no tiene por objeto hacer pasar parte alguna de los bienes del testador a una persona incapaz, o invertirla en un objeto ilícito.

Jurará, al mismo tiempo, desempeñar fiel i legalmente su cargo, sujetándose a la voluntad del testador.

La prestación del juramento deberá preceder a la entrega o abono de las especies o dineros asignados al encargo.

Si el albacea fiduciario se negare a prestar el juramento a que es obligado, caducará por el mismo hecho el encargo.
