Procedimiento. Para proferir la resolución a que se refiere el artículo anterior el Superintendente deberá seguir el siguiente procedimiento:

1. Requerir al dignatario o empleado cuya remoción se pretende solicitar, para que presente por escrito en el término de diez (10) días hábiles, les descargos que considere pertinentes.

2. Una vez vencido el término de que trata el numeral anterior, el Superintendente decretará y practicará en un término de quince (15) días las pruebas solicitadas o las que considere necesarias para resolver.

3. Dentro de los diez (10) días siguientes al vencimiento del periodo para practicar las pruebas se dictará la resolución correspondiente.
