ARTICULO 44 . Quienes deben indemnizar . Están solidariamente obligados a reparar el daño, resarcir los perjuicios causados por el hecho punible y a restituir el enriquecimiento ilícito las personas que resulten responsables penalmente, quienes de acuerdo a la ley sustancial deban reparar el daño y aquellas que se hubieren beneficiado de dicho enriquecimiento. Quienes sean llamados a responder de acuerdo con la ley sustancial, deberán ser notificados personalmente del auto admisorio de la demanda, tendrán el carácter de sujetos procesales e intervendrán en el proceso penal para controvertir las pruebas de las que se derive su responsabilidad.
