El juez deberá decretar pruebas de oficio, en las oportunidades probatorias del proceso y de los incidentes y antes de fallar, cuando sean necesarias para esclarecer los hechos objeto de la controversia.
Las pruebas decretadas de oficio estarán sujetas a la contradicción de las partes.
