º. Cuando no exista proceso penal ni aparezcan sindicaciones contra personas que figuren en las listas de entrega a que se refiere el artículo 2º, el Tribunal Superior Militar, de oficio y de plano, dictará providencia motivada reconociendo a dichas personas los beneficios consagrados en este Decreto. Tal decisión judicial hará tránsito a cosa juzgada.
