No habrá lugar a la extradición cuando por el mismo delito la persona cuya entrega se solicita este procesada o haya sido ya juzgada en Colombia, a menos que se trate de los delitos previstos en el articulo 5° del Código Penal y cuando se reúnan las circunstancias contempladas en el artículo 6° íbidem.
