Salvo pacto en contrario, los derechos de propiedad industrial generados en virtud de un contrato de prestación de servicios o de trabajo se presumen transferidos a favor del contratante o del empleador respectivamente. Para que opere esta presunción se requiere que el contrato respectivo conste por escrito.
