Estará obligado el transportador a cuidar de que la nave se halle en estado de navegar, equipada y aprovisionada convenientemente.

El transportador responderá de las pérdidas o daños provenientes de la falta de condiciones de la nave para navegar, a menos que acredite haber empleado la debida diligencia para ponerla y mantenerla en el estado adecuado, o que el daño se deba a vicio oculto que escape a una razonable diligencia.
