Dispuesta la apertura de la investigación disciplinaria se notificará al investigado y se dejará constancia en el expediente respectivo. En la notificación se debe informar al investigado que tiene derecho a nombrar defensor, y que en caso de no designarlo se le asignará uno de oficio previo el trámite de que trata el artículo 39 de la presente ley, con quien se surtirá la notificación y continuará representándolo en el trámite de la actuación.
