Asimismo se pondrá en libertad al procesado, mediante caución, cuando vencido, el término de ciento ochenta días, contados desde aquel en que se inició el sumario, no se haya dictado auto de proceder, aunque la infracción que se investiga sea de las que no admiten excarcelación.
