º. Cuando el empleador, previo el lleno de los requisitos legales, deba efectuar el pago parcial de una cesantía cuyo valor no haya sido trasladado al Fondo Regional respectiva, podrá deducir de las consignaciones periódicas previstas en el Decreto 98 de 1973 y que correspondan al respectivo trabajador, las sumas que pague por dicho concepto. En tal evento, será necesario presentar ante el Fondo los documentos indicados en el artículo 5º de este Decreto, según sea el caso, a fin de que el fondo acepte dichas deducciones.
