Extemporaneidad de la demanda . Cuando no se presente en tiempo la demanda, el magistrado declarará desierto el recurso y condenará en costas al recurrente.

Siendo varios los recurrentes, la deserción del recurso sólo afectará a quien no presentó oportunamente la demanda.
