Si en los casos de que trata losArtículos 44 y 45 el responsable del acto se excedió de los limites señalados por la ley, por la autoridad o por la necesidad, será castigado con una pena que no sea menor de la sexta parte ni exceda de la mitad de la señalada por la ley, y a la vez la reclusión se convertirá en prisión.
