Derecho de defensa. Las sanciones disciplinarias se aplicarán con observancia del derecho de defensa del inculpado, el cual podrá pedir la asesoría de abogado o de un representante del sindicato legalmente constituido ante el Secretario Ejecutivo de la respectiva Junta de Escalafón, para el efecto de ser oído en diligencia de descargos.
