Efectividad de las garantías. Cuando ocurra el siniestro cubierto por las garantías previstas en este decreto, la entidad que otorga las concesiones, autorizaciones u homologaciones procederá a hacerlas efectivas, mediante la expedición de acto administrativo. Para el caso de garantías otorgadas mediante póliza de seguro, el acto administrativo constituye la declaratoria del siniestro y en el evento de garantías otorgadas por entidad bancaria, la reclamación de la garantía.
