En tiempo de guerra exterior, el colombiano o el extranjero que deba obediencia a la nación a causa de su empleo o función pública, que comerciare con el enemigo extranjero, sufrirá la pena de presidio de dos a ocho años. Si se trata de armas, municiones u otros elementos bélicos, la pena se aumentará hasta el doble.
