Art. 5° Cuando un interesado no pueda presentar personalmente su reclamación por residir fuera del país ó por otra circunstancia cualquiera, constituirá apoderado, y el instrumento en que confiera este carácter, deberá otorgarlo ante Notario con la debida solemnidad. Los poderes otorgados en país extranjero, deberán presentarse autenticados por el Agente diplomático ó Consular de la República más cercano al lugar en que se otorgue el poder, si en el mismo lugar no lo hubiere.
