Art. 3.° El reo varón condenado á arresto puede solicitar de la autoridad encargada de la ejecución de la pena, la conversión de ésta en trabajo en obras públicas, á razón de un día de este por dos de arresto; y dicha autoridad hará la conversión, si a su juicio el reo tuviere las aptitudes necesarias para el trabajo a que deba destinársele; pero en ningún caso se le permitirá al penado pasar la noche fuera de la cárcel.
