En los términos del artículo 12 del Código de Procedimiento Penal, el funcionario administrativo del trabajo que por cualquier medio tenga conocimiento de un hecho que pueda constituir infracción del artículo 309 del Código Penal deberá dar noticia inmediata de esa circunstancia al juez penal competente, sin perjuicio de la investigación administrativa de carácter laboral que estará obligado a adelantar.
