El que no pudiendo ser acusado por delito o delitos de los contemplados en el Artículo anterior, destruyere o inutilizare por cualquier medio y con ánimo de causar daños al Ejército, armas, municiones, provisiones, semovientes, medios de transporte, y en general elementos destinados al uso y servicio del Ejército, será castigado con la pena de cinco a diez años de reclusión militar.
