Solamente cuando se tratare de aprehender a alguna persona, el funcionario de instrucción podrá comisionar a la policía, para allanar el edificio o lugar donde sospeche que se encuentre aquélla, después de que se hayan observado las demás formalidades prescritas en los artículos anteriores.
