Aplicación de las cláusulas excepcionales . Iniciada la acción pertinente, el contratista se obliga a adelantar las diligencias o el juicio hasta su terminación; en caso de morosidad en el procedimiento, ésta solo le es imputable cuando provenga de su culpa, pero si abandona el juicio por tres meses continuos, se declarará la caducidad administrativa del contrato, se harán efectivas la cláusula penal y las garantías respectivas, sin perjuicio de la responsabilidad penal, civil y administrativa a que haya lugar.
