Art. 3.° En caso de guerra esterior, ademas de los cuerpos de la Guardia colombiana, se llamarán al servicio los de las milicias de Ios Estado, hasta el número necesario para defender el territorio de la República.

Parágrafo

Tanto en el caso de guerra interior como en el de guerra esterior, podrá el Poder Ejecutivo organizar las fuerzas fluviales i de mar, hasta el número que considere necesario, conforme al artículo 26 de la Constitucion.
