Las disposiciones sobre sueldos de retiro solo regirán en tiempo de paz, por tanto durante el tiempo de guerra no se descontará el 3 por 100 a los Oficiales en actividad, ni se reconocerán nuevos sueldos de retiro sino por causa de invalidez o enfermedad, y si no se pagarán aquellos sueldos de retiro a quienes habiéndosele reconocido anteriormente se hallen en incapacidad absoluta de presentar sus servicios nuevamente.
