Obligatoriedad del procedimiento. Sin perjuicio del cumplimiento de las condiciones generales establecidas en el Capítulo anterior, el procedimiento de que trata este Capítulo será obligatorio cuando se trate de los seguros asociados a créditos garantizados con hipotecas o a contratos de leasing habitacional, independientemente de que su exigencia sea legal o contractual, y la institución financiera actúe como tomadora de los mismos por cuenta de sus deudores. NOTA DE VIGENCIA: Este artículo fue modificado por el artículo 4 del Decreto 1084 de 2021. Para establecer su aplicación se debe tener en cuenta el régimen de transición dispuesto en el artículo 11 del Decreto 1084 de 2021.
