La excepción de inepta demanda tiene cabida en los casos siguientes:

Cuando la que se propone no reúne los requisitos legales.

Cuando la demanda se dirige contra diversa persona de la obligada a responder sobre la cosa o hecho que se demanda; y

Cuando a la demanda se le da un curso distinto del que le corresponde.
