La pena establecida en el artículo 235 se aumentará hasta el doble si la cuantía de lo hurtado fuere superior veinte mil pesos. Cuando el valor de lo hurtado fuere inferior a trescientos pesos y las circunstancias personales del responsable no revelen mayor peligrosidad, puede el juez imponer la pena de uno a dos años de arresto.
