El Presidente de la República declarará, mediante decreto, y previo concepto del Comité Nacional para la Prevención y Atención de Desastres, la existencia de una situación de Desastre y en el mismo acto la calificará según su magnitud y efectos, como de carácter nacional, departamental, intendencial, comisarial, distrital o municipal.
