Si el que presenta la querella no fuere querellante legítimo y la infracción es de aquellas en que debe procederse de oficio, el funcionario de instrucción la recibirá como denuncio y proceder en consecuencia.

Si la querella versare sobre infracción en que no puede procederse de oficio, el funcionario, por medio de auto motivado, la devolverá al querellante ilegítimo.
