Se aplica la ley colombiana, conforme a lo dispuesto en el artículo anterior, al nacional o extranjero que habiendo sido juzgado en el Exterior, haya sido absuelto o condenado a sanción menor de la que impone la ley colombiana.

Si la sanción cumplida en el Exterior fuere menor que la impuesta en Colombia, se computará la primera como parte descontada de la última.
